Terms of sale – photos

This is a translation for your convenience. In case of differences, the German version is legally binding.

1. Scope

These terms apply to the purchase of digital photos taken by PETKO Photography e.U. (Lazar Petkovic, Rennbahnweg 13/18/8, 1220 Wien, studio@petkophoto.at) on the street or at events and sold via photo.petkophoto.at or on site. Booked shoots (weddings, events, business) are subject to the terms agreed for them.

2. Photos and contract

I only photograph people who agree beforehand. Being photographed is free and there is no obligation to buy. On your personal page you see the photos as watermarked previews. You select the photos you want and confirm your purchase with “Continue to payment” and the subsequent payment. The contract is concluded with your successful payment, or – if you pay cash on site – when you pay the photographer.

3. Prices and payment

The price per photo shown on the page applies. All prices are final prices. As a small business I do not charge VAT (Austrian small business scheme). Payment is made online via Stripe (e.g. card, Apple Pay, Google Pay) or in cash on site. You receive an invoice to download on your page and – if you provide your email address – by email.

4. Delivery

Purchased photos are unlocked on your page immediately after payment, in full resolution and without watermark. The page is available for 30 days. Please save your photos within that time. If you lose them later, write to me – as long as I still have them (up to 12 months), I am happy to send them again.

5. Right of withdrawal

As a consumer you generally have a 14-day right of withdrawal. For digital content not supplied on a physical medium it expires if, before the purchase, you expressly agree that delivery begins immediately and acknowledge that you thereby lose your right of withdrawal. You give this consent with the checkbox before payment. The confirmation is shown on your invoice and in the email.

6. Usage rights

With your purchase you receive an unlimited, non-transferable right to use the purchased photos privately: save, print, give as a gift and share on social media – also cropped or with filters. A tag (@petkophoto) is appreciated. Commercial use (e.g. advertising, resale, press) requires my written consent. Copyright remains with Lazar Petkovic.

7. Warranty and liability

Statutory warranty rights apply. If a photo is technically defective (e.g. the file cannot be opened), please write to me – I will send it again or refund the price. I am liable for slight negligence only in case of personal injury.

8. Privacy

How I handle your data and photos is described in the privacy policy (section 6, in German). In short: no face recognition, payment data is processed by Stripe, photos you do not buy are deleted after 3 months at the latest, purchased photos after 12 months.

9. Final provisions

Austrian law applies. Mandatory consumer protection rules of your country of residence remain unaffected. For questions or complaints, contact me at studio@petkophoto.at.
